GOLIVE App privacy policy

Preamble

Radicalbit S.r.l. (thereinafter “Radicalbit”) provides the GOLIVE Service to Retail Companies (thereinafter “Companies” or “Company”), directly or indirectly through business integration partners (“Partners” or “Partner).
GOLIVE is a platform that allows Companies to publish and manage video events in real-time (“Live Show”), integrated with their e-commerce, in order to allow viewers to buy products in real-time while watching the Live Show.
The GOLIVE App is the tool by which the Company’s employees or collaborators (such as store managers, influencers, personal shoppers, and other professionals) will be able to record and transmit videos that will be integrated into the Live Shows and broadcasted through the GOLIVE Service.
This Privacy Policy is intended for such employees and professionals (thereinafter “Users” or “User”).
By accessing and using the GOLIVE App the User acknowledges having read and understood this policy as well as the practices for collecting and processing personal data.
 

Categories of collected data

Through the GOLIVE App, at the time of registration and during any use of the App, Radicalbit will collect the following data:

  • Personal information such as name and surname, date of birth, contact details, e-mail address, and any profile or biographical information the User elects to provide;
  • Professional details relating to the working relationship between the User and the Company purchasing the GOLIVE Service;
  • Login credentials to access the GoLive App and Service, such as username, password, nickname, and Company ID;
  • Videos, images, and sounds recorded and/or transmitted by the User or for the User through any use of the GOLIVE App and data inferable from such videos and images such as street signs and building names;
  • Device ID or unique identifier, geolocation information, internet protocol (IP) address, device model, and operating system;
  • Data relating to the time and frequency of use of the App and/or the Service.

 

Compulsory or optional nature of data providing and consequences of refusal

The provision of the aforementioned information is optional but it is necessary to access and use the App. Refusal to provide them will have no other consequence than the inability to use the App.
 

Purposes of data processing

Radicalbit collects and processes the aforementioned data in order to provide the GOLIVE Service directly or indirectly to the Company entitled to the Service.

Radicalbit may process the data to improve the efficiency of the GOLIVE Service; compliance with civil, fiscal, accounting laws; fulfillment of obligations deriving from contracts; assistance and technical support regarding the products and services purchased, including after-sales and post-warranty periods; administrative management.

Radicalbit will not process the data to carry out activities towards the User, except in case the User himself requests it to solve technical difficulties relating to the use of the App.
 

Legal basis of the data processing

Primary legal base for processing personal data is the User’s Consent, as expressed through the acceptance of this Policy and the use of the App.

Moreover and in any case, data processing is based on the contractual necessity to directly or indirectly provide the GOLIVE Service to the Company.
 

Data dissemination

Images, videos, and audio recorded by the User or for the User through the App will be broadcasted over the Internet and therefore anyone will be able to receive them since this is the purpose of the GoLive App and Service. The User’s name and nickname and geographic location may also be associated with the said data and broadcasted over the Internet.

The other personal data of the User will not be publicly disclosed in any way.
 

Data communication

All data collected by the App will be communicated to the Company purchasing the GOLIVE Service. In the event that the Service is provided to the Company by a Partner of Radicalbit, the data will be disclosed to that Partner too, who in turn may communicate them to the Company.

THE USER ACKNOWLEDGES THAT ALL DATA COLLECTED BY THE APP WILL BE COMMUNICATED TO THE COMPANY FOR WHICH THE USER WORKS OR COLLABORATES FOR THE BUSINESS PURPOSES OF THE GOLIVE SERVICE.

THE USER IS THEREFORE INVITED TO USE THE GOLIVE APP EXCLUSIVELY TO MAKE GOLIVE LIVE SHOWS AS AGREED WITH THE COMPANY OR THE PARTNER AND NOT TO USE IT FOR PERSONAL PURPOSES.
 

Data transfer outside EU

All data, in the fulfillment of the processing purposes indicated above, may be transferred to third countries outside the European Union. In this case, such transfer will take place in compliance with the provisions of Article 44 and following of the European Regulation.
 

Security of data processing

The personal data are processed with electronic instruments only and are stored in electronic databases. The personal data will be treated in accordance with the provisions of the current legislation and, in particular, in the constant and essential respect for the security measures identified in accordance with art. 32 to minimize the risk of destruction, loss, modification, unauthorized disclosure or access, either accidentally or illegally, or of treatment not complying with the purposes of the collection.
 

Data Retention Period

The data will be kept for the duration of the contractual relationship between Radicalbit and the Company or the Partner and for 12 months following its termination.
 

Rights of the User

Pursuant to articles 12-22 of EU Regulation 679/2016, the User has the right to be informed about the processing of data, and the right to access the data at any time and request the update, integration, and correction. If the conditions provided for by the law are met, the User may also claim the right to cancel data, limit their processing, data portability, opposition to processing, and not be subjected to decisions based solely on automated processing. If the processing of personal data is based on the consent of the User, he/she has the right to revoke the consent given.

If the User believes their rights are infringed, the User can protect their rights by filing a claim to the National Data Protection Authority.
 

Modalities of exercise of rights

For exercising such rights, as well as for more detailed information about the subjects or categories of subjects to whom the data are communicated, the User can contact the personal data holder Radicalbit S.r.l., e-mail dpo@radicalbit.io.
 

Data Processing Holder

This information is provided pursuant to art. 13 of EU Regulation 679/2016 from Radicalbit S.r.l., via Giovanni Battista Pirelli n. 11, 20124 Milan (Italy).
 

Policy Changes

Radicalbit may amend this Policy from time to time. In this case, Radicalbit will post here the amended terms and modify the effective date above below. In case of relevant changes, Radicalbit will notify the User through the App and/or by e-mail.
